Disclaimer: Terms and Conditions 1) Intellectual rights and trademark designs Please note that we would reject any order with label designs that are proprietary brand names, designs or intellectual properties that belong to or are registered by other companies or individuals other then that of the enquirer / customer. We reserve the right to contact and notify the relevant and appropriate authorities as well as the proprietor (if known) should any disparities arise concerning the originality of your label design. Unless otherwise proven to be the property of the enquirer / customer, we will not print any label designs with a registered copyright or trademark insignia. 2) Applicability In the absence of any sample materials as an example of the type of surface of print from you for testing and confirmation purposes, we would have to rely on our existing range of surfaces or through guesswork in order to ascertain the suitable adhesive and ink combinations. Please note that the various types of material spoken of in this site are generic and represent the more commonly used materials that we are familiar with. In light of the wide variety of material surfaces and various types of transfer adhesives available in addition to the varied discrepancies of application by the user, it would be difficult for us to guarantee the quality of our labels. Typically, apart from the vulcanized solvent transfer (see product guidelines) or the fired waterslide transfers on ceramic products (see product guidelines) that are permanent, other transfers may have a more limited adhesion or permanency depending on the method of application and the subsequent condition of wear and tear on the label. 3) Delivery For delivery purposes, we would be using the Malaysian express postal service, Pos Laju. Delivery will take from 1 to 2 weeks depending on the country it would be subsequently sent to. All deliveries are shipped by airmail. As the delivery is serviced by an organization outside our own, we would not be held responsible for late deliveries. However, we will provide full or partial refunds (see money back guarantee) as well as replacements batches in case of any mishap in the delivery. *Please note however, more affordable alternatives are available although the speed and reliability of delivery may be severely compromised. Alternatively, you may also choose to use an international courier of your choice (e.g. DHL, UPS, FedEx). In which case, please contact us to make the necessary arrangements. 4) Quick-Quote Despite our best efforts to quote our label prices as accurately as possible, please note that some of the quick-quote prices quoted here may vary depending on the different variations of your label designs (e.g. effective 'density' area of print) that may influence our final product costing. As such, quick-quote prices do not necessarily always represent our final price quotations. All quick-quote prices are subject to confirmation by Silkmark Sdn. Bhd. and we reserve the right to modify our quick-quote prices in order to reflect possible variations in your label design costs of production. Additionally, please note that the quick-quote prices are not indicative of the total cost incurred, as shipping and insurance expenses are not included and subject to change depending on area and speed of delivery. As we fully understand that you require accurate pricing in order to make an informed decision and purchase, we assure you that any variation of the final quotation from the quick-quote is minimal, if at all. 5) Money-back guarantee And the money-back guarantee scheme is only applicable upon two conditions. Firstly, all of the original label batch must be returned to us at the cost of the sender. Secondly, proof of inapplicability through the use of samples must be sent or photos must be shown. In which case, if we are able to determine the cause of the inapplicability of our labels, we reserve the right to reimburse you with a replacement batch instead of a refund. However, if either the labels were never received or that you have previously provided us with a sample material to test on, either a replacement batch or a complete refund, upon your choosing, would be immediately reimbursed to you. 6) General Silkmark Sdn Bhd is based in Malaysia and we operate within the scope of Malaysian legal system. Any transaction made here are subject to Malaysian customs law and taxes. Silkmark Sdn Bhd will not be held liable or responsible for the intellectual property in label design, proprietary logos or insignias, registered trademarks or copyrights of any, or may have been violated by, our customers, or potential customers from this site. We also reserve the right to terminate any contract or reject any and all orders made to us at our discretion.
